(hereinafter referred to as the provider).
The provider reserves the right to change these Terms and Conditions at any time.
All changes are binding for customers, so we recommend that you regularly review this page.

The provider undertakes to always provide the customer with the following information:
- identity of the company, including name, registered office and registration data
- contact details that enable fast and effective communication
- final price of goods or services, including taxes
- information on any additional costs of transport or delivery
- payment terms and delivery conditions
- information about the complaint procedure within the company
- information about liability for material defects
- possibility and conditions of warranty and the right to withdraw from the contract
- contract duration and period of validity of the offered prices
Prices
All product prices in the online store h2oteam.com are retail prices in EUR and include value added tax.
Delivery costs are not included in the product price. The issued invoice contains the price of the goods
and the delivery costs in the amount shown at the end of the order and on the order confirmation.
Promotional offers and discounts may be weekly or daily. They are set according to demand and available stock.
Discounts do not add up unless explicitly stated.
Legal entities and other VAT payers must provide their VAT identification number when placing an order.
All prices are subject to change without prior notice. Promotional prices apply until cancelled
or until stock is sold out unless a different validity period is specified.
Orders
Data about submitted orders is stored on the website server.
By submitting an order the purchase contract between the final customer and the provider is concluded.
Corrections or additions to an order can be sent by email to

The use of these communication channels does not incur any special costs.
Purchase process
Registration or login
Any user who wishes to make purchases through the website
www.h2oteam.com
can register in advance by clicking on the Registration link and entering the required data.
If the user is already registered and wishes to make a purchase, they click on the Login link.
A purchase is also possible without prior registration.
Selecting products
The user selects the products or services they wish to purchase by clicking the Add to cart button
on the product page. If they wish to buy several products, this step is repeated for each item.
If a product offers different sizes, colors or variants, the customer selects the desired option
before adding the product to the cart.
Once the user has selected all desired items, they click on the Cart button.
A side cart window or cart page opens where the customer can review the order summary
and proceed to checkout.
Checkout and order completion
On the checkout page the user can change the billing details,
enter or edit the recipient data, choose the payment method
and delivery method, and complete the purchase.
After completing the purchase, an order confirmation page is displayed and the user receives
an email confirmation with all order details. The order is stored in digital form on the provider server.
Payment and delivery options
Before completing the purchase the customer can choose among different delivery and payment options.
The provider offers delivery by Express One or personal pickup at the branch office
at Koroška cesta 33 in Maribor (Pristan swimming pool).
The provider offers payment by MasterCard, Visa, American Express and bank transfer to the company account.
The company Jure Daić s.p. operates at the branch office Koroška cesta 33.

Order processing
When the customer submits an online order the purchase contract is considered concluded.
The provider will send the ordered products as soon as possible together with the original invoice.
If the ordered goods are not in stock, the provider will contact the customer to agree
on a later delivery date or replacement product.
Delivery is performed by Express One. The usual delivery time is from one to two working days.
This period may be extended during peak periods, staff absence or larger promotional campaigns
such as Black Friday or major sales. Even in such cases we strive to deliver all orders
within three to four working days.

is available in Slovenian and English languages.
Delivery
Delivery of ordered goods is carried out by Express One SI d.o.o.
The provider is not responsible for any extended delivery times.
Delivery is made to the address you specified when placing the order.
If you are not present at the time of delivery, the courier will contact you
to arrange a new delivery attempt.
In case the product is out of stock, the provider will inform you and
communicate the expected delivery time.
Delivery costs within Slovenia are 3,90 EUR for orders up to 89,99 EUR.
For orders above this amount delivery within Slovenia is free of charge.
If the order includes lead weights with total weight above 2 kg,
the free delivery benefit does not apply. In this case delivery cost
increases proportionally with additional weight.
Delivery is usually from two to three days after payment is received,
except in extraordinary situations.
Delivery is available only within the European Union.
The website www.h2oteam.com
is available only in Slovenian and English.
For deliveries to countries outside the European Union we try to find
a possible solution on request of the customer.
Statutory right of withdrawal and return of goods
A consumer is a natural person who acquires or uses goods, services or digital content
for purposes outside their professional or gainful activity.
In accordance with the Slovenian Consumer Protection Act
a consumer who buys in the online store has the right, in the case of a distance contract,
to inform us within fourteen days from receipt of the goods that they withdraw
from the contract in whole or in part without the need to give any reason.
The withdrawal notice must be sent to the email address
info@h2oteam.com.
The withdrawal period starts on the day after delivery of the goods.
The consumer submits the withdrawal by a clear and unambiguous statement.
The only cost that the consumer bears in relation to withdrawal is the direct cost of returning the goods,
charged according to the price list of the selected delivery service.
If the consumer has already received the goods and withdraws from the contract,
they must return the goods without undue delay and no later than fourteen days after the notification
of withdrawal, unless the company offers to collect the goods itself.
It is considered that the consumer has returned the goods on time
if they send them before the expiry of the fourteen day period to the address:
H2O Team, Koroška cesta 33, 2000 Maribor, Slovenia.
The customer must return the item undamaged, in its original packaging and in unchanged quantity,
unless the item has been destroyed, spoiled, lost or its quantity reduced through no fault of the customer.
The customer may only inspect and test the goods to the extent necessary
to establish their nature, characteristics and functioning.
The customer is responsible for any diminished value of the goods resulting from handling
that is not necessary to determine their nature, characteristics and functioning.
The refund of payments will be made as soon as reasonably possible
and at the latest within fourteen days from the day we receive the returned goods.
The refund will be made using the same payment method that the customer used for the original transaction.
The provider will refuse all parcels sent with cash on delivery that were not agreed in advance.
Returned goods must include a copy of the invoice and the customer personal details
together with the IBAN number of the bank account to which the refund should be made.
In the case of withdrawal from a contract where a discount code or promotional code was used,
only the amount actually paid by the customer is refunded.
If the customer received a free gift as part of the order,
this gift must also be returned when withdrawing from the contract.
In the case of withdrawal from a contract where a gift voucher was used,
the gift voucher is treated as a means of payment and is returned to the customer as a new gift voucher.
The right to a refund in the case of non conformity of goods is regulated by the Consumer Protection Act.
Non conformity of goods
Goods are considered to conform to the contract in particular when:
- they match the description, type, quantity and quality and have the functionality and other features as required by the contract
- they are suitable for the particular purpose which the consumer made known to the seller at the time of contract and the seller agreed with this
- they are delivered with all accessories and instructions as stipulated in the contract
- they are supplied with updates as agreed in the contract
In addition, the goods must also:
- be suitable for the purposes for which goods of the same type are normally used
- be of such quality and correspond to any sample or model made available to the consumer before the contract
- be delivered with accessories and instructions which the consumer can reasonably expect
- have the quantity and features including durability and safety that the consumer can reasonably expect given the nature of the goods and any public statement made in relation to them by the seller or producer
The suitability of the item is checked with another item of the same type that is fault free,
and with the statements of the producer.
The customer must notify the provider of any non conformity with a precise description
and at their own cost within the statutory time period and allow inspection of the item.
The detailed rights regarding non conformity of goods are defined in the Consumer Protection Act.
Regardless of the above, the customer may withdraw from the contract and request an immediate refund
if non conformity appears within thirty days from the date of delivery.
The provider is not responsible for defects that are caused by the customer.
A complaint is not accepted if:
- we determine that the goods were damaged due to incorrect or careless handling
- original protective films and packaging have been removed or there are obvious signs of use

for communication. Email communication is free of charge for the consumer.

as competent for resolving consumer disputes that a consumer may initiate in accordance with the law.

Please read the following Terms and Conditions carefully before purchasing a course.
By completing a purchase or submitting a written application for a course,
you confirm your agreement with these Terms and Conditions.

Promotional prices for courses apply until cancelled.
Orders for courses
Data about submitted course orders is stored on the website server.
By submitting an order the contract for the purchase of the course between the customer and the provider is concluded.
Corrections or additions to the order can be sent by email
or by phone at +386 71 441 900. The use of these communication channels does not incur any special costs.
Course purchase process
Registration or login
Any user who wishes to purchase courses through the website
www.h2oteam.com
must register in advance. The user clicks the Registration link,
enters the required data and confirms.
If the user is already registered, they log in via the Login link.
A purchase is technically possible without previous registration,
but the user must be registered later so that access to online content can be unlocked.
Checkout and order completion
On the checkout page the user can edit billing and recipient details,
choose the payment method and complete the purchase.
After completing the order an order confirmation page appears and
an email with order details is sent to the user.
The order is stored in digital form on the provider server.
Cancellation by the course organiser
H2O Team has the right to cancel scheduled diving courses or workshops
if the minimum number of participants is not reached.
Cancellation may be communicated in writing by email to the participant
no later than five days before the scheduled start of the course or workshop.
In case of cancellation any payments already made will either be refunded
or the participant may choose another available course date or workshop date.
Any further financial claims by the participant because of the cancellation are excluded.
Course conditions
Diving instructors have the right to determine the start and end time of diving courses
and workshops regardless of previous announcements.
Instructors may change the schedule of the course and may conduct the course
with replacement instructors.
All diving courses and workshops are carried out according to the published descriptions.
The instructor is responsible for presenting the course or workshop content.
Participants undertake to follow all instructions given by the instructor.
Participants also undertake to dive in accordance with the standards
presented by H2O Team.
The instructor may exclude from the course or workshop any person who disrupts the course
or does not meet the course requirements. In such a case the participant is not entitled
to a refund of course fees.
Course requirements
Before attending a course participants must fill in an application form,
a medical self assessment form, a basic safe diving rules form
and a personal data processing consent form.
By registering for a course or workshop the participant confirms
that they are not physically limited in a way that would prevent them from safe participation.
The participant must also sign a liability waiver form for the course provider.
Withdrawal by the participant
The participant may withdraw from the contract at any time.
The withdrawal must be made in writing by email to
info@h2oteam.com.
A substitute person cannot attend the course or workshop instead of the original participant.
In the event of withdrawal the provider has the right to charge a flat cancellation fee.
The flat cancellation fee for a scheduled course or workshop is:
- 50 percent of the course or workshop price if the cancellation is made up to seven days before the start
- 100 percent of the course or workshop price if the cancellation is made less than seven days before the start
